The following rules govern use of the TripRoyale portal and the services that we
may offer (the "Portal"), including without limitation email, a searchable
directory of business information, links to other Portals and websites, and access
to news and information.
By using the Portal, you agree to be bound by these Terms and Conditions of Use
(the "T&C"), including but not limited to the Privacy Policy and other
usage guidelines and rules that may be posted from time to time, and to follow the
T&C and all applicable laws and regulations governing the Portal. If you do not
agree, do not enter or use the Portal. Once you have entered this Portal,
your use of the Portal and its services is governed entirely by these terms and
you must perform your obligations set out below as long as you continue to use the
Portal.
TripRoyale may update the T&C from time to time. We are not obliged to inform
you of these changes and you are responsible for checking the Portal periodically
for changes and updates to the T&C. Your use of the Portal following any posted
change(s) to the T&C will be deemed an acceptance of such change(s).
In addition, when using the Portal, you shall be subject to any guidelines or rules,
which may be posted from time to time. All such guidelines or rules are hereby incorporated
by reference into the T&C.
TripRoyale content is planned for use by Users of all ages, but advise against minors
and specifically, children under the age of 18 submitting any content to the Portal
or using the Portal and its services or avail products and services on the Portal.
We do not knowingly collect personal information from minors and would not use it
if it is discovered that it has been provided by a minor.

TripRoyale's Proprietary Rights and Permitted Use
The Portal, including without limitation any content, software and services offered
thereon, are the property of TripRoyale. It is protected by the copyright and/or
other intellectual property laws of India and internationally. You are hereby authorised
solely to view and to retain a copy of pages of this Portal for your own personal
use. Do not duplicate, publish, modify, or otherwise distribute the material on
this Portal unless specifically authorized in writing by TripRoyale to do so. Legal
notices and various other acknowledgements and credits are posted on pages of the
Portal. Do not remove these legal notices or other acknowledgements or credits,
or any related information, contained on pages of the Portal.
You hereby acknowledge and agree that, as between TripRoyale and you, all right,
title, and interest in and to the Portal and the provision thereof, including without
limitation any patent rights, patents, business methods, copyrights, trademarks,
trade secrets, inventions, know-how, and all other intellectual property rights
pertaining thereto, shall be owned exclusively by TripRoyale. Except as expressly
authorised by TripRoyale herein, you agree not to make, copy, display, modify, rent,
lease, license, loan, sell, distribute, or create derivative works of the Portal,
in whole or in part. You agree not to access the Portal by any means other than
through the interface that is provided by TripRoyale for use in accessing the Portal.
In connection with your use of the Portal, TripRoyale may make software available
to you for download from the Portal; your download and use of such software shall
be pursuant to a separate license agreement that shall be agreed to upon your download
or installation of such software. You warrant that you will not edit or otherwise
interfere with any software or programs contained in or obtained from or through
your use of the Portal.
If you have registered or are in the process of registering with TripRoyale, you
warrant that you will not disclose your password to any other person or permit any
other person to make any use whatsoever of any facilities made available to you
by TripRoyale arising from your registration.
User Contributions to the Portal
TripRoyale provides users with the opportunity to contribute to the Portal. You
understand that all information, data, text, links, articles, software, photographs,
graphics, video, music, sound, messages, or other materials posted by you on the
Portal (collectively, the "User Content"), whether publicly posted or privately
transmitted, are the sole responsibility of yours or other users posting or transmitting
such User Content. This means that you, and not TripRoyale, are entirely responsible
for all User Content that you upload, post, email, or otherwise transmit via the
Portal. TripRoyale understands and respects the importance of intellectual property.
It is your obligation to ensure that no copyright, trademark, trade secret, publicity
or privacy rights, or other intellectual property rights are being violated by your
posting or transmission of any User Content via the Portal.
TripRoyale does not control or pre-screen the User Content posted via the Portal
or sent to another user and, as such, does not guarantee the accuracy, integrity,
appropriateness, or quality of such User Content. You are solely responsible for
ascertaining or checking the truth or accuracy of all such material and information
and you agree to accept sole responsibility for any decisions you may make in reliance
upon such material. We make no representations or warranties as to the accuracy
of such material and disclaim any such implied warranties. The User Content posted
by users or other third parties does not necessarily represent the views or opinions
of TripRoyale and under no circumstances will TripRoyale be liable in any way for
any User Content, including, but not limited to, any loss or damage of any kind
incurred as a result of the use of any User Content posted, emailed, or otherwise
transmitted via the Portal.
Users can be held liable for any illegal or prohibited User Content they provide
to the Portal or to other users, including, for example, infringing, defamatory,
or offensive materials. In order that the Portal is available for all users to enjoy,
you may not, and hereby represent and warrant that you will not, post, transmit,
email or otherwise make accessible on or through the Portal User Content that:
- Is unlawful, harmful, threatening, tortuous, defamatory, libelous, abusive, disparaging,
pedophilic, pornographic, obscene, invasive of another's privacy, hateful, or malicious;
- Contains hate propaganda or promotes discrimination or violence against any people
on account of their race, national origin, religion, age, gender, disability, or
sexual orientation;
- Is or could be harmful to minors;
- Harasses or advocates harassment of another person;
- Involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing
(or "spamming");
- Promotes information that you know is false, misleading, or promotes illegal activities
or conduct;
- Is or promotes an illegal or unauthorized copy of another person's work, such as
providing pirated computer programs or links to them, or providing information to
circumvent manufacture-installed copy-protect devices;
- Infringes any patent, copyright, trademark, service mark, trade secret, or other
proprietary right of any other party;
- Contains restricted password only access pages, or hidden pages or images (those
not linked to or from another accessible page);
- Provides material that exploits people under the age of 18 in a sexual or violent
manner, or solicits personal information from anyone under 18;
- Provides instructional information about illegal activities such as making or buying
illegal weapons, or providing or creating computer viruses;
- Contains a software virus or any other code files or programs that are designed
to or have the ability to interrupt, destroy, compromise, or otherwise limit the
functionality of any computer software or hardware or telecommunications equipment
whether owned by TripRoyale or any other party;
- Solicits passwords, or personal identifying information for commercial or unlawful
purposes from other users; or
- Otherwise violates any local, state, national or other applicable law or regulation.
In addition, you may not, in connection with your use of the Portal:
- Impersonate any person or entity, including a TripRoyale officer or employee, or
falsely misrepresent your affiliation with any other person or entity;
- Forge headers or otherwise manipulate identifiers for the purpose of disguising
the origin of any User Content posted or transmitted through or on the Portal;
- Engage in commercial activities and/or sales without TripRoyale's prior written
consent including, without limitation, contests, sweepstakes, barter, or advertising;
- Post or transmit any Content that you do not have the right to post or transmit;
- Post or submit unsolicited commercial e-mail, chain letters, pyramid schemes, or
seek or encourage others to engage in these activities;
- Disrupt the ordinary flow and operation of any portion of the Portal, including
causing a screen to scroll faster than another User may be able to type in a chat
room or bulletin board environment;
- Interfere with or disrupt the Portal or any server or network involved with the
operation of the Portal;
- Stalk or harass any other person; or
- Collect or "harvest" from the Portal the names of other users for the purpose of
transmitting to those other users unsolicited commercial messages.
If you discover this kind of material or activity on the Portal, please notify us
at feedback@triproyale.com. You must
provide us with sufficient information to identify the material notified of and
the nature and particulars of your notification and with your contact information
including a valid e-mail address at which you may be contacted. We will use our
best efforts to investigate all notifications as soon as is reasonable in the circumstances,
and may at our sole discretion take remedial action including but not limited to
removing the material in question. Depending on what action if any we decide to
take, we may contact you to explain our decision but we are not obliged to do so.
If we consider that the contents of a submission, or that of material stored elsewhere
is inaccurate or amounts to inappropriate use of our Portal or in breach of these
Terms and Conditions, we reserve the right to refuse to allow it to appear in TripRoyale
or to amend it prior to its appearance. We also reserve the right, but have no obligation,
to read and/or edit and/or delete any data or image or text submitted to us or has
appeared on our Portal and to otherwise restrict its dissemination if, in our absolute
discretion, it is deemed to be unacceptable. We may notify you if we have amended
or rejected your submission but we are not obliged to do so.
License to User Content
While you warrant not to use the Portal in a manner that infringes any person’s
copyrights or other intellectual property rights or interferes with other Users’
lawful use of the Portal or infringes any person’s privacy, you agree only to include
in your submissions to TripRoyale only such information or material in respect of
which you own the copyright or have the permission of the owner to publish the material.
While the copyright remains with its owner, you grant us a non-exclusive, perpetual,
royalty-free, worldwide license to republish any material you submit to us in any
format, including without limitation print and electronic format.
With respect to User Content you elect to post or transmit for inclusion in or on
the Portal, you grant TripRoyale and its affiliates and partners the perpetual,
world-wide, royalty free, non-exclusive, sub-licensable license as follows: to use,
reproduce, translate, alter, perform, display, modify, adapt, and publish such User
Content, in whole or in part, in all present and future media and in any manner
relating to the Portal (including without limitation in connection with the appearance
of such User Content on TripRoyale and on the Portals of our affiliates, partners
and others with whom TripRoyale may have business relationships relating to the
Portal) and the distribution and promotion of the Portal. You further agree that
TripRoyale is free to use any ideas, know-how, concepts, techniques or other materials
you send us for any purpose.
We may transfer the ownership of the website www.triproyale.com
at any time, and we may transfer any information or material we hold on the Portal
(or other information or material you have provided us) to the transferee without
notice to you.
Without limitation of any of the rights granted to TripRoyale herein, you acknowledge
and agree that TripRoyale may preserve User Content and may also disclose User Content
if required to do so by law or in the good faith belief that such preservation or
disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce
the T&C; (c) respond to claims that any User Content violates the rights of third-parties;
or (d) protect the rights, property, or personal safety of TripRoyale, its users
and the public.
Your Registration Obligations
In consideration of your use of the Portal, you agree to: (a) provide true, accurate,
current and complete information about yourself as prompted by the Portal's registration
form (such information being the "Registration Data") and (b) maintain and promptly
update the Registration Data to keep it true, accurate, current and complete. If
you provide any information that is untrue, inaccurate, not current or incomplete,
or TripRoyale has reasonable grounds to suspect that such information is untrue,
inaccurate, not current or incomplete, TripRoyale has the right to suspend, terminate,
or refuse any and all current or future use of the Portal (or any portion thereof).
Password and Security
You will receive a password and account designation upon completing the Portal's
registration process. You are responsible for maintaining the confidentiality of
the password and account, and are fully responsible for all activities that occur
under your password or account. You agree to (a) immediately notify TripRoyale of
any unauthorized use of your password or account or any other breach of security,
and (b) ensure that you exit from your account at the end of each session. TripRoyale
cannot and will not be liable for any loss or damage arising from your failure to
comply with this Section. Without limitation to the generality of the foregoing,
due to the nature of Internet, computers, data flow, and other technical and economical
practicalities, the Portal, like most computer data and Internet applications, is
vulnerable to various security issues and hence should be considered unsecured.
By using the Portal and the Internet in general, you may be subject to various risks,
including, among others, eavesdropping, sniffing, spoofing, forgery, spamming, "imposturing",
tampering, breaking passwords, harassment, fraud, electronic trespassing, hacking,
system contamination including without limitation, viruses, worms, Trojan horses,
causing unauthorized, damaging or harmful access and/or retrieval of information
and data on your computer and other forms of activity that may even be considered
unlawful. Information (including Registration Data, passwords and User Content)
received or delivered or intended to be made available on and through the Portal
may be subject to these and other security or privacy hazards or may not reach its
destination or reach an erroneous address or recipient. The Portal is not different
than other applications in this respect. Without limitation of the foregoing, although
we take seriously the security of all member accounts and other personal and non-personal
information associated with our visitors and participants, due to the open communication
nature of the Internet, we can not guarantee that your account will be free from
unauthorized access by third parties.
Indemnity
You agree to indemnify and hold TripRoyale, its subsidiaries, affiliates, officers,
agents, co-branders, and other partners and employees, harmless from any loss, liability,
claim or demand, including reasonable attorney's fees, made by any third party due
to or arising out of User Content you submit, post to, or transmit through the Portal,
your use of the Portal, including your use of the Portal to provide a link to another
Portal or to upload content or other information to the Portal, or your violation
of the T&C or any applicable laws or the rights of another.
Links and Search Results
The Portal may provide links and automatically produce search results, or third
parties may provide information, that reference or link to other World Wide Web
sites or resources. TripRoyale has no control over such Portals and resources, and
you acknowledge and agree that TripRoyale is not responsible for the content or
information contained therein. TripRoyale cannot and does not guarantee, represent,
or warrant that the content or information contained in such third-party Portals
is accurate, legal and/or inoffensive. TripRoyale does not endorse the content or
information of any third-party Portal or resource, and further does not warrant
that such Portals or resources will not contain viruses or otherwise impact your
computer. By using the Portal to search for or link to another Portal, you agree
and understand that TripRoyale shall not be responsible or liable, directly or indirectly,
for any damages or loss caused or alleged to be caused by or in connection with
your use of, or reliance on, the Portal to obtain search results and/or to link
to another Portal. However, if you have a problem with a link from the Portal, please
let us know at feedback@triproyale.com
No Resale of Portal or Portion Thereof
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial
purposes, any portion of the Portal, use of the Portal, or access to the Portal,
without the express, prior written consent of TripRoyale in each instance.
Modifications to Portal
TripRoyale reserves the right at any time and from time to time to modify or discontinue,
temporarily or permanently, the Portal (or any part thereof) with or without notice.
You agree that TripRoyale shall not be liable to you or to any third party for any
modification, suspension, or discontinuance of the Portal.
Service Providers, Third Parties and Travel Information on the Portal
The accommodation, vacation packages and other service providers listed on the Portal
are independent contractors / third parties and are not agents or employees of TripRoyale.
TripRoyale acts only as a booking agent and facilitates the User / customer to identify
and / or contact the accommodation or other service providers listed on the Portal.
TripRoyale is not liable or responsible for the acts, errors, omissions, representations,
warranties, breaches or negligence of any such suppliers or service providers or
third parties or for any personal injuries, death, damage to property or other damage
or expense resulting therefrom. TripRoyale does not have any liability and will
make no refund in the event of any delay, cancellation, overbooking, strike, force
majeure or other causes beyond our direct control.
TripRoyale recommends accommodation and travel services through its own direct and
personal travel experience, as achieved either by visiting the facilities or by
way of reference from known and reliable sources, including its own customers. TripRoyale
makes useful recommendations to the traveller based on such direct experience through
TR stamp and ratings. While TR stampindicates that the service provider is recommended
by TripRoyale, the ratings are based on a scientific matrix of quality and depth
of service. These ratings and recommendations are indicative of the general service
levels/reputation of the provider and is neither a certificate nor is it possible
for TripRoyale to guarantee superior service on an ongoing basis. Ratings and recommendations
displayed on the Portal are accordingly, intended as general guidelines TripRoyale
does not guarantee the availability or quality of the third party’s products and
services. The information is thus provided without warranty of any kind.
Although most travel, including travel to overseas destinations, is completed without
incident, travel to certain destinations may involve greater risk than others. TripRoyale
urges passengers to review travel prohibitions, warnings, announcements and advisories
issued by various Governments and travel regulatory organisations prior to booking
travel to various destinations
By offering to sell travel and other services, TripRoyale does not represent or
warrant that the travel or other services is without risks and is not liable for
damages or losses that may result from your travel or availing of the services.
Booking with / through TripRoyale
You acknowledge that TripRoyale pre-negotiates certain room rates and tariffs /
rates with accommodation suppliers and other service providers to facilitate the
booking of reservations on your behalf. The room rates and other tariffs/rates displayed
on the Portal are either pre-negotiated room rates or rates published by the service
providers. By making a booking with / through TripRoyale, you authorise TripRoyale
to book reservations for the price indicated, which includes the room rate displayed
on the Website, plus tax recovery charges, and our service fees. Upon submitting
your reservation request you authorize TripRoyale to facilitate hotel reservations
on your behalf, including making payment arrangements with accommodation suppliers
and other service providers.
You may cancel or change your prepaid hotel reservation or other booking, but you
will be charged a cancellation or change fee. Additionally, if you do not cancel
or change your reservation before the cancellation policy period applicable to the
hotel or service provider with whom you reserved, you will be subject to charges
as applicable in the service provider’s policy. You must make refund requests for
no-shows or early checkouts within 60 days after checkin date or date of commencement
of your trip in the case of vacation packages.
TripRoyale expressly reserves the right to correct any pricing errors on our website
and / or on bookings which are pending. In such a situation, you will be provided
and opportunity to either continue availing the service at the revised price or
cancel your reservation.
You agree to pay any cancellation or change fees associated with your booking. In
limited cases, some accommodation providers do not permit changes to or cancellations
of reservations after they are made, as indicated in their rules and restrictions.
You agree to abide by the terms and conditions imposed with respect to your prepaid
accommodation reservations and other bookings through our portal. You are responsible
for familiarising and abiding with the rules, restrictions and policies applicable
to your booking.
Suspension and/or Termination Rights
TripRoyale reserves the right, at its sole discretion, immediately and without notice,
to suspend or terminate the T&C, your registration for any program, your ability
to access the Portal, your ability to utilize any email services offered on the
Portal, and/or to remove any User Content, for any reason, including without limitation,
any breach by you of the T&C or conduct by you that TripRoyale determines to be
inappropriate. You agree that TripRoyale shall not be liable to you or any third-party
for any suspension or termination pursuant to this provision.
Privacy Policy
We believe that your privacy and the privacy of all of our users are important.

Maintenance of Operations
We will endeavour to maintain the operation of the Portal but from time to time
we may need to suspend it without notice in order to carry out maintenance and improvements
and we may be prevented from operating by causes beyond our reasonable control (including,
without limitation, strikes, labour disputes, acts of God, fire, flood, storm, war,
riot, civil action, malicious damage, compliance with any law, governmental or regulatory
order, rule, regulation or direction, any act or omission of any government or other
competent authority, accident, equipment or services failure). We do not accept
responsibility for any interruptions or failures in the Portal.
We are not responsible to you or anyone else for any loss, direct, indirect, consequential,
special or general damages, liability, cost, disbursement or expense incurred in
connection with your use of the Portal or any software accessible through the Portal
or any delay in accessing or inability to access the Portal or your reliance upon
any of its content.
Back-Up
TripRoyale is not liable for any lost data resulting from the operation of our Portal
and/or the enforcement of the T&C (including without limitation content from any
e-mail account hosted by TripRoyale), and is not obligated to maintain back-up copies
of any contributed User Content or e-mail messages. We recommend that you retain
a copy of all User Content that you post or distribute to, or through, the Portal.
You understand and agree that TripRoyale may release information about you if required
by law or subpoena, or if the information is necessary or appropriate to release
to address an unlawful or harmful activity.
India Laws & Regulations
TripRoyale encourages users from around the world to use the Portal. However, if
you choose to use the Portal, you understand, acknowledge and agree that your use
of the Portal is governed by the T&C and the laws and regulations of India regarding
online conduct and acceptable content. If you use the Portal in a jurisdiction that
prohibits or restricts the use of the Portal, you agree that your use of the Portal
will be at your own risk, without limitation of any other provision of the T&C,
and that TripRoyale shall not have any liability with respect to such use. Software
from this Portal is subject to India laws & regulations.
Disclaimer of Warranties
You expressly understand and agree that:
- Your use of the Portal is at your sole risk. The Portal, and its content, are delivered
on an "as is" and "as available" basis. TripRoyale expressly disclaims all warranties
of any kind, whether express or implied, including, but not limited to, the implied
warranties of merchantability, fitness for a particular purpose, or non-infringement.
TripRoyale makes no warranty that the Portal or any related services, such as email,
links, or searches offered on the Portal will be error-free, uninterrupted, timely,
secure, or that it will provide specific results from use of the Portal or any content,
search or link therein. TripRoyale further cannot ensure that files you download
from the Portal will be free of viruses, Trojan horses, bugs, contamination, or
destructive features.
- Any material viewed, downloaded, or otherwise obtained through the use of the Portal
is done solely at your own discretion and risk, and TripRoyale will not be liable
for any damages of any kind arising from the use of the Portal, including, without
limitation, direct, indirect, incidental, punitive, or consequential damages.
- No advice or information, whether oral or written, obtained by you from TripRoyale
or through or from the Portal shall create any warranty not expressly stated in
the T&C. Data and information relating to securities or otherwise is provided for
informational purposes only, and is not intended for trading purposes. Neither TripRoyale
nor any of its data or content providers shall be liable for any errors or delays
in the content, or for any actions taken in reliance thereon.
Limitation of Liability
You expressly understand and agree that TripRoyale shall not be liable for any indirect,
incidental, special, consequential or exemplary damages, including but not limited
to, damages for loss of profits, goodwill, use, data or other intangible losses
(even if TripRoyale has been advised of the possibility of such damages), resulting
from: (i) the use or the inability to use the Portal; (ii) the cost of procurement
of substitute goods or services resulting from any goods, data, information or services
purchased or obtained or messages received or transactions entered into through
or from the Portal; (iii) unauthorized access to or alteration of your transmissions
or data; (iv) statements or conduct of any third party on the Portal; or (v) any
other matter relating to the Portal or the content thereon, including without limitation
any user content posted thereon.
If, despite the limitation above, TripRoyale or their respective service providers,
contractors, suppliers or third parties are found liable for any loss or damage
which arises out of or in any way connected with any of the occurrences described
above, then TripRoyale or the respective service providers or contractors or suppliers
or third parties liabilities will in no event exceed, in the aggregate, the greater
of (i) the transaction fees assessed for your transactions on the Portal or (b)
Indian Rupees One Thousand
By way of clarity, the transaction fees mentioned in the above paragraph represents:
(i) In the case of User / customer booking accommodation, vacation packages or other
services or purchasing products through the Portal, the total amount received from
the User / customer for availing the services less any cancellation, refund or other
charges, as may be applicable
(ii) In the case of service provider or business partner or third party for services
such as listing / promotions / advertisements, the total amount received from the
service provider for availing the services less any cancellation, refund or other
charges, as may be applicable, in proportion to the period for which the applicable
service has not been rendered by TripRoyale.
In no case shall the liability include any consequential loss, damage or additional
expense whatsoever.
Exclusions and Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the limitation
or exclusion of liability for incidental or consequential damages. Accordingly,
some of the above limitations may not apply to you.
Miscellaneous
The T&C constitutes the entire agreement between you and TripRoyale and governs
your use of the Portal, superseding any prior agreements between you and TripRoyale.
You may also be subject to additional terms and conditions that may apply when you
use affiliate services, third-party content, or third-party software.
You agree that the T&C and the relationship between you and TripRoyale shall be
governed by the laws of India without regard to its conflict of law provisions.
You agree to submit to personal and exclusive jurisdiction by and venue in the State
of Karnataka, India. The failure of TripRoyale to exercise or enforce any right
or provision of the T&C shall not constitute a waiver of such right or provision.
If any provision of the T&C is found by a court of competent jurisdiction to be
invalid, the parties nevertheless agree that the court should endeavor to give effect
to the parties' intentions as reflected in the provision, and the other provisions
of the T&C remain in full force and effect. You agree that regardless of any statute
or law to the contrary, any claim or cause of action arising out of or related to
use of the Portal or the T&C must be filed within one (1) year after such claim
or cause of action arose or be forever barred.
The section titles in the T&C are for convenience only and have no legal or contractual
effect.
